Resource Guide for Conditions for Coverage -1-9-09

Network 8 is pleased to announce the release of a newly developed resource guide for the Conditions for Coverage. This document is a streamlined version of the Interpretive Guidance document that was released by CMS on October 3, 2008. Though not meant to serve as a stand-alone document, and certainly not meant to replace the Interpretive Guidance, it is hoped that this resource will be a beneficial guide to understanding the new requirements. The attached ESRD Program Interpretive Guidance represents the most recent guidance related to the 42 CFR Part 494 Conditions for Coverage for ESRD facilities. This Interpretive Guidance should replace all previously-released versions.

Comprehensive Mulitdisciplinary Patient Assessment - 9-29-08

The Department of Health and Human Services (HHS), Centers for Medicare and Medicaid Services (CMS), published the Final Conditions for Coverage (CfC) for End-Stage Renal Disease (ESRD) Facilities on April 15, 2008. In anticipation of the final publishing of the CfC for ESRD facilities, CMS encouraged the National Kidney Foundation (NKF) and American Nephrology Nurses’ Association (ANNA) to establish a task force to develop resources and guidelines to assist facilities in complying with the requirement for a comprehensive, multidisciplinary patient assessment (CMPA).

This document was created for educational purposes only. The assessment questions are intended to provide examples of the types of questions that physicians, registered nurses, dietitians, and social workers may want to use to meet the requirements for a CMPA. The validity and reliability of the questions have not been confirmed. It is the responsibility of the user to verify that the use of any of the questions from cited sources does not violate any copyright laws.

The implementation and interpretation of the new Conditions for Coverage for End-Stage Renal Disease Facilities is anticipated to be a dynamic process. This document reflects the information available to the kidney community as of its version date. Please confirm with NKF or ANNA whether further information, resources, or guidance has been provided on this subject. The information provided is not intended to establish or replace policies and procedures provided by dialysis providers to their facilities. CDC Documents - 9-16-08

Specific pages of the following CDC documents are incorporated into the Conditions for Coverage by reference and have the authority of regulation. What this means, practically speaking, is that if the recommendation or guideline uses terms such as "should" or "may", for all intents and purposes, those words should be interpreted as "will".

New ESRD Regulations

The new ESRD Regulations were published April 15, 2008 and went into effect on October 14, 2008. Compliance with rules regarding separate room for HBsAg+, Life Safety Code, certification for technicians, and furnishing data for ESRD program administration are required by later dates, as noted.
